7. Limitation of Liability

BirdFlai UG shall be liable without limitation for damages caused by intent or gross negligence. In cases of slight negligence, BirdFlai UG shall only be liable for breaches of essential contractual obligations (cardinal duties), limited to foreseeable, typically occurring damages. This does not affect liability under the German Product Liability Act (Produkthaftungsgesetz) or liability for injury to life, body, or health.

8. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. If the user is a merchant (Kaufmann), a legal entity under public law, or a special fund under public law, the exclusive jurisdiction for all disputes shall be the registered office of BirdFlai UG.
